Partner terms

1. Who these terms are for

These terms apply between Wellspeech (details below, "we") and businesses we have accepted into the partner programme ("you"), such as wedding planners, celebrants, officiants, toastmasters and venues. The programme is for businesses and the self-employed, not for consumers. Our clients’ orders are governed by our terms and conditions.

2. Joining

You apply with the form on the partner page. We decide on each application and may decline it without giving reasons. When we accept you, we send you your partner code and link by email. Joining costs nothing, and there is no minimum number of orders.

3. Commission

You receive 25% of the net amount of every order placed through your partner link while you are a partner. The net amount is the amount the client paid, less the VAT included in it and the payment fees for the order.

There is no commission on orders that are refunded, withdrawn from or charged back. If this happens after we have included the order in a statement, we deduct its commission from your next statement.

Clients you refer pay the normal price. You may not offer or promise them a discount in our name.

4. Attribution

An order counts for you when the client reaches our website through your partner link and places the order from the pages that link led to. Your code travels in the address of our pages; we do not use cookies or store anything on the client’s device for this. An order placed after the client arrived another way (for example through a search engine or by typing our address) cannot be counted, and we do not attribute orders afterwards on request. If a client has followed the links of several partners, the last link counts.

Our payment records decide which orders count. You may ask us to explain any statement.

5. Statements and payout

For every month with orders through your link we send you a statement by email in the first half of the following month. It lists each order with its date, the amount paid, VAT, fees, the net amount and your commission. It never names clients or shows what they wrote.

We pay by bank transfer to the account you give us, in Swiss francs or euros, within 30 days of the statement, once your unpaid balance reaches CHF 50. Smaller balances carry over to the next month. Commission on orders in other currencies is converted at the exchange rate of the statement date. When the partnership ends, we pay any balance.

You are responsible for declaring your commission and for any taxes and social security contributions on it. The amounts we pay include any VAT you may owe on them; if you are registered for VAT, tell us and send us an invoice for each payout.

6. What we ask of you

  • Recommend us honestly. Say that the speeches are written with AI from the client’s own stories, and do not promise results, discounts or features we do not offer.
  • No spam. Share your link with your own clients and contacts, on your website and in your own channels, and send emails or messages only where you are allowed to.
  • No paid search ads on our name: do not bid on "Wellspeech" or similar terms, and do not use our name in domain names, app names or social media account names.
  • No coupon or cashback websites, no rewards for clicks, and no automated or fake clicks.
  • No self-referrals: orders you place for yourself, your business or your own events earn no commission.
  • Always tell your clients that you receive a commission when they order through your link, for example with the words "partner link: I receive a commission if you order" next to it, in your welcome guide or in the email. If you act for your clients under a mandate (for example as their wedding planner), you may also have to tell them the amount and pass it on to them unless they agree otherwise.
  • You may name us in plain text to refer to us. Do not change our logo or suggest that we endorse anything beyond this partnership.

7. Data protection

We do not pass client data to you: you receive only the figures in your statements. We process your details (name, business, contact and bank details) to run the partnership, as described in our privacy policy.

8. Ending the partnership and changes

Either side may end the partnership at any time by email. We may end it with immediate effect, and withhold the commission on the orders concerned, if you break these terms. Commission on orders placed before the end remains due under section 5.

We may change these terms with 30 days’ notice by email. If you do not agree, you may end the partnership before the change takes effect.

9. Liability

We are responsible for our service to the clients you refer. We do not promise any number of orders or any income. Neither side is liable to the other for indirect or consequential loss, except for intent and gross negligence.

10. Applicable law and place of jurisdiction

These terms are governed by Swiss law. The exclusive place of jurisdiction is Lucerne, Switzerland.
