Privacy policy
This policy explains what personal data we process when you use this website, why, and your rights under the EU General Data Protection Regulation (GDPR).
1. Controller
[Full legal name]
[Street and number, postcode and city, country]
Email: [Email address]
2. Visiting the website
When you open a page, our hosting provider (Render Services, Inc., USA; servers in Frankfurt, Germany) processes technical data such as your IP address, the page requested, date and time, and your browser type, to deliver the site and keep it secure (Art. 6(1)(f) GDPR). Server logs are kept for a short period and then deleted. We do not use analytics, advertising trackers or third-party fonts, and no cookies except the sign-in cookie that is set only when you sign in (section 4a).
Your answers in the speech form, your finished speeches and the reference of your last order are saved in your own browser's local storage so you do not lose them. This data stays on your device; you can delete it by clearing your browser's site data.
If you arrive through a tagged link (for example from one of our social media posts, with utm_source and similar parameters in the address), our page carries the name of that channel and campaign, and the host name of the website you came from (such as pinterest.com, never the full address), along the links of our site, in the page address only and without storing anything on your device. If you then order, we store this short channel label with your order at Stripe, and we count visits and orders per channel in daily totals. This tells us which channels bring customers; it contains no personal data beyond your order, and the totals are not linked to you. The legal basis is our legitimate interest in measuring our marketing (Art. 6(1)(f) GDPR); the label is deleted with the order.
3. Previews and speeches
To write a preview or a speech, we send the details you entered to Anthropic, PBC (USA), which runs the Claude AI model, as our processor (Art. 6(1)(b) GDPR, contract and pre-contractual steps). Anthropic does not use data sent through its commercial API to train its models and deletes it after a limited retention period. Please only enter what is needed for the speech. If you mention other people, such as the couple or a person who has died, make sure you are comfortable sharing those details.
4. Orders and payment
Payments are processed by Stripe Payments Europe, Ltd. (Ireland) and Stripe, Inc. (USA). Stripe receives your payment details, email address and billing data.
To deliver your speech and revisions without a separate database, we store your form answers, the number of revisions used, the time and wording version of your withdrawal consent and the latest version of your speech with your order at Stripe, so you can reopen it on any device (Art. 6(1)(b) and (c) GDPR). Order records are kept for as long as tax and commercial law requires (up to 10 years in Germany, Art. 6(1)(c) GDPR).
Our money-back promise applies once per customer. When we refund an order under it, we keep a one-way hash of your email address and of your card's fingerprint (a code Stripe gives each card, not the card number) on our server for 3 years, so a second request can be recognised and passed to a person. We cannot turn the hash back into your address. The legal basis is our legitimate interest in preventing misuse of a voluntary refund (Art. 6(1)(f) GDPR).
4a. Signing in
Signing in is optional. It lets you see all speeches paid with your email address on one page ("My speeches"); every speech also opens with the link in its confirmation email without signing in. When you sign in, we set one cookie in your browser that holds only your email address, how you signed in (the sign-in method) and when it expires (after 30 days, or when you sign out). The cookie is signed so it cannot be altered, and nothing about your sign-in is stored on our server. To list your speeches we look up the orders for that email address at Stripe (section 4) each time you open the page. During sign-in a second cookie keeps a random security code for up to 10 minutes and is then deleted.
The legal basis is the contract with you (Art. 6(1)(b) GDPR): showing you the speeches you bought. These cookies are strictly necessary for the sign-in you ask for (§ 25(2) no. 2 TDDDG), so no consent banner is needed.
5. Help desk and support assistant
The assistant on our help page is an AI system, not a person. Your messages, and the order reference and email address if you enter them, are sent to Anthropic (see section 3) to write the answer (Art. 6(1)(b) and (f) GDPR). Chats are not stored on our server. The assistant checks an order only when the reference and email match. If it opens a support ticket, we store your email address (if given), a short summary and the last messages of the conversation, with card numbers removed, on our server in Frankfurt for 180 days, and forward them to us by email.
For running the business we also keep daily totals on our server (for example the number of visits, previews, orders and errors). They contain no personal data and no IP addresses.
6. Memories from friends and family
A speaker can create a share link and send it to friends and family, who can then send a memory for the speech. When you send one, we store your name, how you know the person, your memory and the time you agreed, on our server in Frankfurt (Render, see section 2). Only the speaker who created the link can see it; other friends who use the same link never see your memory. The speaker can remove it at any time, and everything sent through a link is deleted 60 days after the link was created. The legal basis is your consent (Art. 6(1)(a) GDPR), which you can withdraw at any time by asking the speaker to remove the memory or by emailing us; this does not affect processing before the withdrawal.
If the speaker chooses your memory for the speech, it becomes part of their speech details: it is sent to Anthropic to write the speech (section 3) and stored with their order at Stripe (section 4). The speaker's link and its secret key are saved in the speaker's browser.
6a. Group packs and shared tributes
If you order a group pack (for example a wedding party pack, a team speech pack or a shared tribute for a funeral), the details each further speaker enters for their speech (their role, first name, relationship, stories and wishes) and the latest version of their speech are stored on our server in Frankfurt (Render, see section 2) and deleted 180 days after the order. They are sent to Anthropic to write that speech (section 3), and a short summary of each speaker's stories is included when the other speeches of the pack are written, so the speeches do not repeat each other. The legal basis is the contract (Art. 6(1)(b) GDPR) and, for the details about other people, our and the speakers' legitimate interest in a coordinated set of speeches (Art. 6(1)(f) GDPR). Anyone with one of the pack's speech links can see these details and speeches, so the buyer should share the links only with the speakers. Draft counts are stored with the order at Stripe (section 4).
7. Transfers outside the EU
Anthropic, Stripe and Render are based in the USA. Transfers rely on the EU-US Data Privacy Framework where the recipient is certified, and otherwise on the EU Standard Contractual Clauses.
8. Contacting us
If you email us, we use your message to answer you (Art. 6(1)(b) or (f) GDPR) and delete it when it is no longer needed.
9. Your rights
You have the right to access, rectification, erasure, restriction of processing, data portability and to object to processing based on legitimate interests. To exercise them, email us. You also have the right to complain to a data protection supervisory authority, for example the one in the German state where we are based.
